Review of Licensing Policy
The Council has published a draft revised Statement of Policy relating to the Licensing Act 2003. This is the second three yearly revision of the Policy and takes into account the Council’s experience of administering the Act revisions to the Act and case law resulting from it.
The Policy sets out the Council’s approach to dealing with applications made to it for personal and premises Licences under the Licensing Act. It is one of the matters that the Licensing Committee or sub-committee must take into account when considering applications referred to it. The others are the Act itself and the Guidance issued by the Department of Culture Media and Sport under the Act.
The revised policy is much shorter than the previous versions. This is because a number of sections which were considered to be advisory have been removed. These sections will be added to the guidance notes and advice sections of the Council’s website in due course.
The draft policy can be found here. Paper copies are also available for consultation at public libraries in the district, the Council’s Offices at Kelham Hall and at the offices of Ollerton & Boughton, Southwell and Newark Town Councils.

All comments will be reported to the Council’s Licensing Committee for consideration for inclusion in the final policy to be adopted by the Council to come into force from 7th January 2011.
