We have responsibility for issuing a variety of personal and premises licences ranging from those under the Licensing Act 2003 to Lotteries and Raffles, Taxis, Animal licences and Beauty Treatments.
 
Some of this work is undertaken by the Corporate Services Area of the Council and some by the Housing and Environmental Services Section.
 
What we currently Licence
 
We process a wide variety of licence applications. The main licence applications are as follows:
 
Licensing Act 2003
 
The District Council has responsibility for personal, premises and club premise licences under the Licensing Act 2003. These licences are required for any premises wishing to sell or supply alcohol, late night refreshments or provide regulated entertainment.
 
Premises Licence 
 
The Licensing Service aims to provide a safe, well-regulated environment, at places licensed by the Council and to protect the interests of local residents. By licensing premises the Council is able to ensure that licence holders abide by licence conditions and regulations so that premises are well run and to ensure public safety. The Council takes action against licence holders who break their licence conditions.
 
Personal Licences
 
A Personal Licence is required by those who sell or supply alcohol or who supervise the selling or supplying of alcohol. The licensing of individuals separately from the licensing of premises permits the movement of Personal Licence holders from one premise to another, allowing greater flexibility.
 
Temporary Event Notice (TEN)
 
A Temporary Event Notice can be used either to allow licensable activities to take place on otherwise unlicensed premises or to extend the times when licensable activities take place on licensed premises or to permit additional licensable activities on such premises.  A notice has to be served on both the Council and the Police at least ten working days before the event.  There are limits on the number of TENs that can be served each year, both by individuals and in relation to premises.  
 
Gambling and Amusements with Prizes
  
The Council has acquired a number of licensing functions as a result of the Gambling Act, which relate to premises containing gaming machines, amusements with prizes and various gambling activities. 
 
Hackney Carriages or Private Hire Licensing
 
Hackney Carriage/Private Hire Drivers Licences are granted by the Council to people that drive hackney carriages (taxis) or private hire vehicles. Similarly, vehicles have to be licensed by the Council before they can be used for hire and reward within the district.
 
Raffles, Totes and Lotteries 
 
The Gambling Act 2005 enables societies to conduct lotteries (this covers raffles and totes) for raising money for charitable, sporting, cultural and other similar activities provided the purpose of the lottery would not result in private gain or benefit to any person as an individual or any commercial undertaking. In order to obtain the benefits of the Act, the society must register with their local authority.
 
House to House Collections 
 
A House to House Collection is an appeal to the public by charitable organisations by means of visits from house to house. This may include visits to homes leaving envelopes or plastic sacks.  Collections by charities for either goods or money carried out door to door need to be licensed by the Council.  Collections by private firms of goods which may be sold and a portion donated to charity do not require licensing for this purpose but the operators may need licensing as waste carriers.
 
Street Collections
 
A Street Collection permit is required to collect money or sell articles for the benefit of any charitable purpose in any street or public place. Collectors should have sealed collecting tins stating which organisation they are collecting on behalf and should not act in any such manner as to cause or be likely to cause danger, obstruction, inconvenience or annoyance to any person.
 
Animal Licensing
 
We are involved in the licensing of various business and activities that involve animals. These include licences for boarding kennels and catteries, licenses to breed dogs and keep dangerous wild animals, and licences for riding establishments, pet shops and zoos.
   
Hairdressing
 
There is specific legislation covering hairdressing salons which include complying with the Health and Safety at Work Act 1974. Where a hairdressing salon employs staff for more than 21 hours per week there is a requirement to register the Salon with this Authority.
 
Special Treatment / Beauty Treatments
 
These are premises that provide a wide variety of treatments, the main ones being sauna, massage and sun beds. Special treatments also include all beauty treatments provided by salons i.e. leg waxing, manicure, and pedicure, facials, eyelash tinting, electrolysis etc. Besides the premises for special treatment having to be licensed, the therapist who provides the treatment also has to be registered with the Council.
 
Skin Piercing Activities
 
Operators of skin piercing activities, which include acupuncture, tattooing, skin piercing and electronlysis must be registered with a local authority. Operators of these businesses also are required, within the remit of the Health and Safety At Work, Etc. Act 1974, to conduct their operations in ways that are safe, healthy and where staff and customers are not put at risk.
 
Houses in Multiple Occupation (HMO's)

The Housing Act 2004 has introduced a new licensing regime to raise the standard of accommodation for people living in dwellings referred to as Houses in Multiple Occupation (HMOs). Since April 2006 mandatory licensing has been in force for landlords of certain specified types of property.
 
Caravan Sites
 
The Caravan and Control of Development Act 1960 prohibits the use of land as a caravan site unless the occupier holds a site licence issued by the local authority.
