Land interest

This privacy notice explains how Newark and Sherwood District Council processes personal data for land interest queries. 

Who we are

Newark and Sherwood District Council is the data controller for the personal information collected by our data processor, TerraQuest, through a land interest questionnaire.

Why we collect your information

We are collecting information about people and organisations with an interest in land or property at Yorke Drive, Newark. We will use it to:

  • identify owners, occupiers and others with a legal or financial interest in the land
  • confirm the nature and extent of those interests
  • issue notices to all freeholders, leaseholders, tenants, occupiers and parties with other land interest in the scheme; pursuant to Section 16 of the Local Government (Miscellaneous Provisions) Act 1976
  • contact interested parties about the Yorke Drive regeneration scheme
  • support land referencing, valuation, negotiation and legal work
  • meet our statutory duties and maintain an accurate audit record

Information we collect

This may include:

  • your name and contact details
  • the address and description of the land or property
  • details of ownership, occupation, tenancies, leases, rights, restrictions and other interests
  • information about agents, solicitors, lenders or other representatives
  • supporting documents and correspondence
  • signatures and questionnaire completion details

Our lawful basis

We process this information because it’s necessary:

  • to perform a task carried out in the public interest or in the exercise of official authority vested in the Council; and/or
  • to comply with a legal obligation
  • to comply with relevant legislation or statutory functions are to follow the process in making a Compulsory Purchase Order with Section 17 of the Housing Act 1985 and Section 13 of the Local Government (Miscellaneous Provisions) Act 1976 and Section 16 of the Local Government (Miscellaneous Provisions) Act 1976

Where appropriate, we may also process information because it’s necessary for the establishment, exercise or defence of legal claims.

Sharing your information

Where necessary, we may share information with:

  • council officers, professional advisers and contractors working on the project
  • land referencing agents, surveyors, valuers and legal advisers
  • government departments, statutory bodies, courts, tribunals or inspectors
  • organisations involved in acquiring, developing or managing the land
  • other parties where disclosure is required or permitted by law

We won’t sell your personal information.

How long we keep your information

We will retain the information for seven years after completion of the land referencing process , in line with the council’s retention schedule. Information required as part of a permanent property, legal or statutory record may be kept for longer.

Your rights

Depending on the circumstances, you may have rights to:

  • access your personal information
  • have inaccurate information corrected
  • object to or restrict its use
  • request deletion where there’s no lawful reason to retain it

Some rights may be limited where the council must process or retain information to perform its statutory functions.
